TERMS AND CONDITIONS

IMPORTANT NOTICE

THIS AGREEMENT CONTAINS IMPORTANT PROVISIONS REGARDING THE REMEDIES AVAILABLE TO CUSTOMER IN THE EVENT OF A DISPUTE BETWEEN CUSTOMER AND BUCKEYE TURF. PLEASE REFER TO THE SECTION ENTITLED “CLASS ACTION WAIVER.”

1. INTRODUCTION

These Terms and Conditions (“Terms”) describe the services and business practices of Buckeye Turf (“Company”). These Terms apply to all services contracted by website, phone, email, or other communication methods. Together with written proposals or agreements, these Terms constitute the entire Agreement between Buckeye Turf and the Customer and supersede all prior communications or agreements.

2. TERM

This Agreement becomes effective on the date of the initial service and continues until properly canceled. One-time services are governed solely for that service.

3. CUSTOMER ACKNOWLEDGEMENTS AND RESPONSIBILITIES

Customer affirms they are at least 18 years of age, authorized to approve services, and have read and agreed to these Terms. Customer agrees to follow all service instructions, including watering requirements where applicable.

4. ACCESS TO PROPERTY

Customer authorizes Buckeye Turf to access the property as reasonably necessary to perform services. Buckeye Turf may move personal property as needed and will attempt to notify Customer of schedule changes.

5. BUCKEYE TURF GUARANTEE

For customers purchasing five or more fertilization and weed control applications annually, Buckeye Turf will provide corrective visits if necessary. If issues persist after 30 days, Buckeye Turf may continue service or refund the most recent service payment.

6. SERVICE AND WARRANTY LIMITATIONS

Service effectiveness may vary due to environmental factors beyond Company control. Buckeye Turf may refuse unsafe or impractical service requests. All services are provided in lieu of any other express or implied warranties.

7. CONTINUOUS SERVICE

Ongoing services automatically renew annually unless canceled. Pricing may increase due to economic factors.

8. CANCELLATION

Customer may cancel services by calling 614-502-5757. Services already performed remain payable. All prepaid amounts are non-refundable.

9. BILLING

Invoices are issued after service and are due upon receipt. Late balances may incur fees. Credits apply to future services only.

10. AUTO-PAY AGREEMENT

Enrollment in Auto-Pay is required for ongoing services. Customer authorizes automatic electronic payment processing upon invoicing.

11. LATE FEES

Balances unpaid after 30 days may incur a 0.66% monthly service charge. Returned payments are subject to a $25 fee.

12. NON-PAYMENT

Failure to pay may result in termination of services. Customer is responsible for collection costs including attorney’s fees.

13. COMMUNICATION CONSENT

Customer consents to receive service and marketing communications via phone, email, and text message. Message and data rates may apply. Reply STOP to unsubscribe.

14. NOTICE OF CLAIM

Customer must provide written notice of any claim within 60 days and allow Buckeye Turf opportunity to investigate and cure.

15. MANDATORY ARBITRATION

All disputes shall be resolved by binding arbitration in Ohio under AAA Commercial Arbitration Rules.

16. TIME LIMIT FOR CLAIMS

Claims must be initiated within one year of the last service date or alleged act.

17. LIMITATION OF LIABILITY

Liability shall not exceed the amount paid for services during the applicable calendar year. Indirect and consequential damages are excluded.

18. FORCE MAJEURE

Buckeye Turf is not liable for delays caused by events beyond its control.

19. GOVERNING LAW

This Agreement is governed by the laws of the State of Ohio.

20. ATTORNEY’S FEES

Customer agrees to reimburse reasonable attorney’s fees if Buckeye Turf successfully enforces this Agreement.

21. CLASS ACTION WAIVER

Customer waives participation in class or representative actions. Claims must be brought individually.

22. MODIFICATIONS

Buckeye Turf may update these Terms. Continued service constitutes acceptance.

23. SEVERABILITY & SURVIVAL

If any provision is unenforceable, remaining provisions remain valid.
